General Conditions of Carriage
1. GENERAL CONDITIONS

1.1 These General Conditions apply to the time Integrated Distribution Services Telefónica SAU (hereinafter Zeleris) accepts the shipment, except agreements or conditions specified in another contract to provide logistics and transportation services. The General Conditions presented here also apply to the carriage letters issued electronically.
2. DATA SERVICE SHIPPING AND RESTRICTIONS

2.1 The sender provides its responsibility under the contract data relating to the nature of the goods, sender and recipient. These data will not be checked by Zeleris unless serious imminent risk or order of authority.

2.2 Zeleris does not offer carriage of dangerous goods (ADR) or perishable, so sending such goods by the sender exempts Zeleris of any contract or tort, in which case Zeleris reserves the right to suspend transport.
3. DELIVERY

3.1 The shipments are delivered to the address of the Recipient provided by the Sender.

3.2 In cases where due to weight, volume or characteristics of the property which is required of delivery or collection it is unable to make the delivery or collection will be in the front door or offices that have Zeleris on arrival, agreement with the recipient or sender.

3.3 The approximate time of delivery depending on the service contract are:

Zeleris next day: Between 24 and 48 hours of collection.
Zeleris 10: Before 10.00 am on the day after collection. Subject to availability (see website).
Zeleris 14: Before 14.00 pm the day after collection. Subject to availability (see website).
Zeleris international air: According area and availability. (See www.zeleris.com).

3.4 Services are provided Monday through Friday, excluding periods of calculating holidays in the locality of origin and destination. Delivery times may be affected by organizational causes of Zeleris by destination. Delivery by postal code and location are available on www.zeleris.com.
4. LATE DELIVERY

4.1 There shall be deemed delay in that delivery caused by the absence or change of the recipient, recipient or unknown address registered, non-payment of postage, refunds, closing for holidays, late deliveries second delivery attempt or later, force majeure or unforeseeable circumstances, or any other non-attributable to Zeleris.
5. LIABILITY AND INSURANCE

6. CLAIMS AND RESERVES

6.1 In the case of loss or damage to goods, the consignee shall indicate at the time of delivery and in writing on the delivery note what constitutes such damages or faults. Otherwise it is assumed that the goods have been delivered correctly.

6.2 If the damage or losses were impossible to appreciate at the time of delivery a written complaint to Zeleris must be made no later than 7 calendar days and prove that such damages or losses are attributable to Zeleris.

6.3 In order to proceed with the processing of claims for damage or cracks in any type of contract, will be essential to the conservation of the packaging of the goods stricken by the customer and staff Zeleris display.
7. PACKAGING

7.1 The shipments are delivered with appropriate and sufficient packaging. Overall shipments using original manufacturer packaging, or the sender unless clearly appreciate and manifest lack of protection, according to their content, in which case Zeleris reserves the right to accept for shipment will be accepted due to insufficient packaging.

7.2 In case of rejection of packages due to insufficient packaging or other reserves sufficiently motivated in the consignment and acceptance by the sender of them, Zeleris not responsible for failures that may occur in the goods, suffice for this purpose brand customer in the space of the delivery note.
8. REFUNDS

9. NOTICE OF STEP

10. DEPOSIT AND DISPOSAL OF GOODS

10.1 In cases of impediments to transportation or delivery, non-payment of freight or expense or refund, Zeleris may unload the goods and guard it on behalf of the person entitled to them. 11. CUSTOMS CLEARANCE

11.1 The sender must provide appropriate documentation to the Customs Office, responsible for its accuracy and validity. The costs of customs clearance for export shall be borne by the customer. Unless otherwise agreed, the costs of import customs clearance and other taxes and expenses and customs penalties are payable by the consignee (recipient) and be satisfied at the time of delivery of the goods.

11.2 The rates of this section do not include taxes (Ex. VAT, VAT) or other chargeable expenses necessary to give effect to the delivery of the shipment at destination and as provided in the preceding paragraph shall be paid by the consignee .
12. CALCULATION OF FUEL SURCHARGE

The calculation of fuel surcharge applied by Zeleris is based on the monthly average diesel fuel prices published by the Ministry of Industry. Prices quoted are published with a lag of two months, which determines the reference price for the application of the fuel surcharge will correspond to two months before the billing period (eg. In March 2013 the surcharge will be billed as and those published for January 2013) prices.

13. JURISDICTION

13.1 Any dispute concerning the application or interpretation of these general conditions of carriage and irrespective of the amount in dispute and any contract entered into pursuant thereto, shall be submitted to the jurisdiction of the Arbitration Board Community Transportation de Madrid.
14. ASSIGNMENT OF PERSONAL DATA

14.1 The sender consents the transfer of your personal data to Integrated Distribution Services Telefónica SAU commercial and administrative purposes and may exercise rights of access, rectification and opposition as provided in Law 15/99 of 13 December, by writing to the address on the front.
